Education Committee:

Subject to the specific approval of the Board of Governors, this committee shall have jurisdiction and authority over all matters pertaining to the Annual Meeting of the Association and shall make available such programs and information suitable for schools, seminars, district meetings, and the Annual Convention. Additionally, the Committee will monitor and make recommendation on emerging trends and issues affecting education for the funeral service in the interest of recruitment/retention of member of our profession.

Legislative Committee:

The Legislative Committee shall have charge of all matters pertaining to legislation affecting funeral directors of this state.

Suggested goals: Monitor legislation impacting funeral service/small businesses; serve as liaison to Iowa Board of Mortuary Science; and develop ways to educate legislators on funeral service issues.

Membership Committee:

The Membership Committee shall investigate all applicants for membership as to their standing in the profession and their qualification for membership in this Association and shall, if satisfied as to the eligibility of the applicant, certify said applicant to the Board of Governors with a favorable recommendation of admission. The committee will oversee Scholarship requirements and recipients, Aware of Excellence criteria and recipients, and Milestone Achievement recipients.

Suggested goals: Develop a format for member services information dissemination; leadership training opportunities for members and member follow-up programs; evaluate IFDA publications’ effectiveness, timeliness and knowledge being presented to members.

Ad Hoc Committees:

AS ISSUES ARISE – ON AN AS-NEEDED BASIS. IFDA seeks the names of individuals who would be willing to serve on Ad Hoc Committees. Remembering a Tragedy, Recognizing a Profession, and Preserving an Important Chapter in Iowa History

On July 19, 1989, Iowa and the entire nation were shocked by a devastating event: the United Flight 232 tragedy in Sioux City, which resulted in the loss of 112 lives. On the 35th anniversary of this tragedy, we honor the memory of those lost and the bravery of those who responded.

On that day, emergency services and first responders worked tirelessly to save lives, yet another group rose to the occasion to care for those we lost: funeral directors. Many of them mobilized in Sioux City by stepping up with unwavering resolve and offering dignity and compassion to the victims and their surviving families of this tragedy.

During the Presidential Banquet at the Iowa Funeral Directors Association’s (IFDA) 144th Annual Convention on April 16th, IFDA together with Funeral Directors Life (FDL), paid tribute to the funeral directors and embalmers present on that fateful day by sharing an excerpt of what we hope will be a full-length documentary, directed and produced by FDL (in partnership with IFDA), that honors the work funeral directors do every day.

We are anticipating the completion of the documentary to be this fall, but we need your help to continue the story. By contributing to this documentary, you will help us shed light on the invaluable services funeral directors offer, their dedication to their communities, and the profound impact they have in the aftermath of disasters. Secret Shopper Alert! FTC Funeral Rule Compliance Checks

FTC Sends Warning Letters to Funeral Homes After First Undercover Phone Sweep | Federal Trade Commission

Special Bulletin Update: NFDA’s Comment on FTC’s Telephone Pricing Sweep

Yesterday, the Federal Trade Commission (FTC) announced that it is sending warning letters to 39 funeral homes across the country. It discovered several violations of the Funeral Rule as a result of the agency’s first undercover phone sweep. Since COVID, the FTC has only announced one round of in-person secret shopper results. SEE HERE In this new phone version of the secret shopper, reportedly conducted in 2023, investigators and other staff from the FTC’s East Central Region, Northwest Region, Southeast Region, Southwest Region, Midwest Region, Western Region – Los Angeles, Western Region – San Francisco offices and the Bureau of Consumer Protection’s Division of Marketing Practices placed undercover calls to more than 250 funeral homes from across the country to try to obtain price information. From this investigation, FTC Staff determined that 39 of the more than 250 funeral homes violated the Funeral Rule on these calls. Part of the difficulty in assessing compliance is the subjectivity of the shopper. While the compliance rate certainly should be higher, the FTC reported a more than 85% compliance rate, which is consistent, if not higher than, the result of prior in-person secret shopper sweeps.

As a result of this action, the FTC reported: On 38 calls, funeral homes either refused to answer questions about pricing at all or provided inconsistent pricing for identical services; On one call, a funeral home misrepresented that the local health code required remains to be embalmed if more than a certain number of people wanted to view the remains; and, On one call, a funeral home promise to send a General Price List, but instead provided a list of package prices that did not meet the Funeral Rule requirements for a General Price List. The letters sent by the FTC reminds funeral providers that the Funeral Rule requires them to provide price information over the telephone, asks them to take prompt remedial action to prevent future violations, and reminds them that failure to comply with the rule result in penalties of up to $51,744 per violation. To see the FTC’s press release and a list of the locations to which the FTC sent letters CLICK HERE As you know, the Funeral Rule requires that funeral providers tell persons who inquire by telephone accurate information about their offerings or prices from their price lists and any other readily available information that reasonably answers their questions. This includes when the caller is a price list consolidator, competitor, or anyone else whether they are a potential customer or not. Additionally, while funeral providers may ask callers to identify themselves, they cannot require callers to give their names, addresses, or phone numbers, and must provide them the required information, regardless. The FTC also advises that funeral providers should not highlight only package prices and must include itemized and minimal services. When people call with pricing questions, you’re not required to provide them price lists electronically, but even if you do, you must still answer their questions over the phone. Sending them price information via other means doesn’t meet your obligation under the Funeral Rule.

However, funeral providers may: Use answering machines to record incoming calls or to advise callers to call a specified number during business hours to get price information; Decline to provide price information outside of regular business hours if that is the provider’s normal practice; and, Take a message if in the middle of an arrangements conference and call back to provide price information at a later time. In each of these cases, the Rule requires that the funeral provider furnish price information promptly by returning the telephone call. Further, it is a violation of the Rule to misrepresent state or local laws or make other deceptive statements, such as falsely claiming that the law requires embalming when that isn’t the case. Removal Technician Efforts in Iowa

October 2023 Update

While Bill S193, which addresses the use of removal technicians, was officially passed and implemented on July 1, 2023, it’s important to note that this was done with the requirement of establishing rules by the Board of Mortuary Science (BMS).

In June 2023, the IFDA Board and Ad-Hoc committee diligently presented a set of rules to the BMS that were designed for clarity and ease of compliance. To craft these rules, a committee was formed by the Board of Mortuary Science, comprising of three public members and three board members. Initially, two meetings were held to discuss these rules. However, the second meeting encountered challenges due to disagreements with the BMS Executive Director and Assistant Attorney General.

Regrettably, the rules were not thoroughly discussed with the committee during this second meeting, leading to the decision to return for further discussion at the next board meeting. IFDA firmly stood by the direction of the legislation, and subsequently, the rules were referred back to the committee for comprehensive discussion. Currently, we are eagerly awaiting a meeting to be scheduled by Executive Director, Susan Reynolds.

It’s important to emphasize that, at present, unlicensed individuals cannot be used for removals. IFDA remains committed to keeping you updated on any developments and progress in this matter.
